Abstract
[Normative art and inertia. The imprecision of juridical thinking]. The article develops its theo-retical framework by taking as its point of departure two poems: Amo i gesti imprecisi, by Magrelli, and Pensiero che non sente, by Cavalli. After offering a philosophical justification of the method adopted, it explores the relationship between art and inertia in law, under-stood as the tension between creative art and instrumental inertia. It argues for the consti-tutive imprecision of juridical forms, with particular attention to theoretical and legal forms. It then examines the normative significance of the graphic element in the textual, iconic, musical, and digital forms through which law is positivised. Finally, it argues that artistic sensibility is indispensable if jurists are to learn how to use the instruments of pos-itive law – and, where necessary, to exceed the limits of their prescribed use.
